What Are the Different Charges for a DUI in Springfield, IL?
By Dan Noll on October 23rd, 2015 in
In Illinois, there are six separate charges that may be brought against a person for driving under the influence. The most common is driving under the influence of alcohol. In order for a person to be proven guilty of driving under the influence of alcohol, the state must prove beyond a reasonable doubt that a person is under the influence of alcohol when, as a result of drinking any amount of alcohol, his mental or physical faculties are so impaired as to reduce his ability to think and act with ordinary care.
The state must prove each and every one of those elements beyond a reasonable doubt. The most common way that is done is through the use of field sobriety tests by officers, by officers’ testimony as it relates to the person’s driving, and their interactions with that individual.
